1. About OpeningSong

OpeningSong ("we," "us," "our") is a music fan engagement platform operated by OpeningSong, based in Geneva, Switzerland. Our platform allows fans to earn credits by supporting their favorite artists through streaming, community engagement, concert attendance, and merchandise purchases. Artists can use the platform to identify and reward their most dedicated fans.

By creating an account or using our services, you agree to these Terms of Service. If you do not agree, please do not use the platform.

2. Eligibility

You must be at least 13 years old to use OpeningSong. If you are under 18, you must have permission from a parent or guardian. By using the platform, you represent that you meet these requirements.

3. Account Registration

To use OpeningSong, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You may connect third-party accounts (Last.fm, Apple Music, SoundCloud, Instagram, TikTok) to track your music engagement. By connecting these accounts, you authorize us to access the data described in our Privacy Policy. You can disconnect any third-party account at any time from your Settings page.

You agree to provide accurate information and to keep your account information up to date. We reserve the right to suspend or terminate accounts that violate these terms or our Community Guidelines.

4. Credits and Rewards

Opening Credits ("credits") are a virtual point system within the platform. Credits have no monetary value and cannot be exchanged for cash. Credits are earned through activities including streaming, community engagement, concert attendance, and merchandise purchases.

Credits can be redeemed for rewards offered by artists on the platform. The availability, cost, and nature of rewards are determined by individual artists. We do not guarantee the availability of any specific reward.

We reserve the right to adjust credit values, earning rates, and reward costs at any time. Credits may be forfeited if your account is terminated for violations of these terms.

5. Concert Check-ins and Location Data

Our concert check-in feature uses GPS location data to verify your attendance at live events. By using this feature, you consent to the collection and processing of your location data for the purpose of verifying concert attendance and awarding credits.

Location data is only collected when you actively initiate a check-in. We do not track your location in the background. Location data is stored securely and used only for check-in verification and fraud prevention.

6. User Content

You may post content in artist spaces including text, images, and links. You retain ownership of content you create, but you grant OpeningSong a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content within the platform.

You are responsible for the content you post. Content must comply with our Community Guidelines. We reserve the right to remove content that violates our guidelines or these terms.

7. Artist Accounts

Artists may apply for verified accounts to manage their spaces, create rewards, and engage with fans. Artist verification is at our discretion. We reserve the right to approve or reject artist applications for any reason.

Artists are responsible for fulfilling rewards they create. OpeningSong facilitates the connection between artists and fans but is not a party to reward transactions.

8. Prohibited Conduct

You agree not to:

Create fake accounts or impersonate others; manipulate streaming data, engagement metrics, or credit calculations; buy, sell, or transfer accounts or credits; use bots, scripts, or automated tools to interact with the platform; circumvent security measures or exploit vulnerabilities; harass, threaten, or abuse other users; post illegal, harmful, or offensive content; or use the platform for any purpose other than its intended use.

9. Intellectual Property

OpeningSong and its original content, features, and functionality are owned by OpeningSong and are protected by international copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.

10. Disclaimers

OpeningSong is provided "as is" without warranties of any kind, either express or implied. We do not guarantee uninterrupted or error-free service. We are not responsible for third-party services integrated with our platform (Last.fm, Apple Music, SoundCloud, etc.) or for their availability, accuracy, or performance.

11. Limitation of Liability

To the maximum extent permitted by law, OpeningSong shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including loss of credits, rewards, or data.

12. Changes to Terms

We may update these terms from time to time. We will notify registered users of material changes via email. Your continued use of the platform after changes take effect constitutes acceptance of the updated terms.

13. Governing Law

These terms are governed by the laws of Switzerland. Any disputes arising from these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of Geneva, Switzerland.
